I'm trying to locate someone who may be able to sell a complete set of copied articles by James Powell in Model Railroad News in 2002 and 2003. This was a series about constructing the Woodland Scenics Grand Valley layout. I've tried to contact the magazine publisher but they do not have all of the back issues available. I don't need the entire magazine, just copies of the articles. Many thanks in advance.
 
Soliciting copies from copyrighted publications has been discussed here before. The forum owner can't allow this without incurring some serious legal problems and really discourages this type of request. If you'd like to purchase back issues from someone here who may have them, that's no problem but copying specific articles without the copyright owner's permission is. I don't subscribe to RMN but there may be someone here who does and might even be willing to send them for the cost of postage.
 
U.S. copyright law prohibits commercial use of copyrighted material. The law specifically allows material to be copied for personal use. My use is personal, not professional. I will gladly pay for a full magazine if necessary. However, I can't find anyone with a complete set of back issues.

I have contacted the publisher. They don't have any interest in helping me. They claim to know nothing at all about the author. It was my impression that model railroaders were generally helpful. I guess those folks have gone the way of steam locomotives.
 


Your understanding of the copyright law is not correct. You can copy something you already own for your own personal use. I cannot copy something I own for your personal use. As I said, someone here may have back issues and be willing to send them to you. I suggest you give it more than six hours to see if someone can help you out before you assume that I'm being unhelpful. That is one problem I have always had with the copyright law. I totally support writers being paid for their work, but I disagree with the law not allowing you to copy out of print work that you are willing to buy.

I believe that there should be some provision that allows you to legally acquire a copy of out of print works when none are available for sale.
 
There already is such a law in place, called the "Orphan Act". If, using best efforts, the author of a copyrighted work and the means of publication of the copyrighted work can not be located, the copyrighted work may be assumed to be in the public domain, although it is always the person using the copyrighted work's obligation to prove "best efforts" if a lawsuit should ensue. In this case, it appears both the author and the publication still exist and can be contacted. Until "best efforts" are made to to contact the author and publication about fair use of their copyright, it must be assumed that the full copyright protection remains in full force.
