George, that photo was taken along one of the great lakes in Ontario near Nippigon, I believe. I went thru there with the high rail last fall, awesome scenery!
The photo above it is just West of Thunder Bay Ontario and the bridge in the background was the CNR line from Sioux Lookout.
I'm going to miss that job!

Ken's right... However, what you're going to use it for may well matter to the photographe when you contact him about using them (which is the only right way to do it.)
For example, if you dropped me a note saying "I'd like to use one of your photos to make a dozen or so home made Christmas Cards to send to my friends" I'd probably say "Fine, as long as you note who the photo is from..."
If you say "I'm going to sell them at the train show" then I'll say "OK, well then let's talk about my fee..."
In many cases photographers will respond nicely when you ask, in advance, for permission to use a photo.
By the way, let's say you do it without asking? My understanding is that they're entitled to treble damages of the going rate. So if the photo was from a pro and worth $500, now it will cost you $1,500 for the use. You'd also most likely end up paying his lawyer fees too... Not much fun.
That photo is definitely along Lake Champlain. It's on the former Deleware & Hudson line, and it's a favorite railfan photo spot. I recall seeing quite a few photos of the D&H PA's running past there, in fact I think one was on the cover of Railfan magazine if I recall correctly.
It's got the lake, the cliff and even a retaining wall. Very similiar setting, and in fact I could just as easily mistaken that location for Lake Champlain had I been shown that photo without a caption...

I took so many photos on that run and most are rock, trees, and water.

I have something very similar I'm working on right now. I painted and installed the track last night, time for some ballast, ground foam, weeds and bushes now.
